New update of International Trade Regulation
(Issue 22). Includes two Appellate Body reports on DSU Article 21.5
cases. One of these approved the amended US rules on sunset reviews,
and examined the extent to which a new evidentiary base can be used in
anti-dumping proceedings when the original measure has been condemned.
In the other case, concerning the Price Band System used by Chile, the
Appellate Body explored the burden of proof in compliance proceedings.
Article 21.5 also came up before a panel when the US attempt to use
compliance proceedings to retry the original dispute was rejected in

case the CFI found manifest errors of assessment as regards injury
findings. Although no new investigations have been launched since
December, the number of new reviews has not diminished. |
